1. General Provisions
1.1. These Terms of Service ("Terms") govern access to and use of Taleino ("Taleino", "Service", "we", "us", or "our"), a digital service for creating personalized children's stories.
1.2. The Service is provided by FOP Gaitan Kyrylo Oleksandrovych ("Provider").
1.3. By creating an account, placing an order, or otherwise using a paid feature of Taleino, the customer ("User", "you", or "Customer") agrees to these Terms.
1.4. Where applicable, these Terms constitute a public offer and electronic agreement between the Provider and the User.
1.5. The agreement is concluded electronically and does not require a handwritten signature.
1.6. The Provider may maintain electronic records of the User's acceptance of these Terms, including the date and time of acceptance, the applicable version of the Terms, and other technical information reasonably necessary to demonstrate acceptance.

1.8. If any provision of these Terms conflicts with a mandatory consumer protection law applicable to the User, the mandatory legal provision will prevail.
2. Definitions
2.1. "Provider" means FOP Gaitan Kyrylo Oleksandrovych, the owner and operator of Taleino.
2.2. "User" means a person who accesses or uses Taleino or places an order through the Service.
2.3. "Service" means the Taleino website, web application, story creation functionality, ordering system, and related digital services.
2.4. "Personalized Story" means a digital children's story created using information and preferences provided by the User, including, where applicable, a child's name, age, characters, interests, themes, settings, and other personalization information.
2.5. "Order" means a request submitted by the User to purchase a Taleino product or service.
2.6. "Digital Content" means digital stories, illustrations, files, text, images, or other digital materials supplied to the User through Taleino.
2.7. "Account" means a registered User account used to access Taleino features and manage Orders.
2.8. "Order Information" means information submitted by the User for the purpose of creating a Personalized Story.
3. Description of the Service
3.1. Taleino provides tools for creating personalized children's stories in digital form.
3.2. Depending on the product purchased, Taleino may generate a Personalized Story based on information supplied by the User.
3.3. The exact features, content format, delivery method, and price of each product are presented on the relevant Taleino product or checkout page before purchase.
3.4. Taleino may use automated systems, artificial intelligence, third-party technology, and other digital tools to create or process the Personalized Story.
3.5. Because the Service involves automated and creative content generation, the final wording, illustrations, narrative structure, and other creative elements may vary between orders.
3.6. Taleino does not guarantee that generated content will correspond exactly to an example, preview, reference image, or wording shown on the website, provided that the delivered product substantially corresponds to the product description and applicable consumer requirements.
4. Personalized Content
4.1. The User is responsible for the accuracy of the information submitted for personalization.
4.2. Before submitting an Order, the User should carefully review:
- names and spelling;
- age information;
- selected characters;
- selected themes;
- selected preferences;
- other information used to personalize the story.
4.3. Taleino is not responsible for errors in a Personalized Story that result directly from incorrect or incomplete information supplied by the User.
4.4. If technically possible, Taleino may offer the User an opportunity to correct an error or request regeneration of the affected content.
4.5. A request to regenerate content because the User changed their creative preferences after the Order has been completed may be treated as a new or discretionary request and does not automatically create a right to a refund.
5. Eligibility and Accounts
5.1. Users must provide accurate information when creating an Account or placing an Order.
5.2. Unless otherwise permitted by applicable law, Users must be at least 18 years old or use the Service with the involvement and authorization of a parent or legal guardian.
5.3. If a parent or legal guardian purchases a Personalized Story for a child, the parent or legal guardian remains responsible for the information submitted to Taleino.
5.4. Users are responsible for maintaining the security of their Account credentials.
5.5. Users must not:
- share Account credentials with unauthorized third parties;
- attempt to access another User's Account;
- use another person's payment credentials without authorization;
- create Accounts for fraudulent or abusive purposes.
6. Orders and Payments
6.1. Prices for Taleino products are displayed on the website and/or checkout page before the Order is submitted.
6.2. The applicable price is the price displayed to the User at the time the Order is placed, unless otherwise stated.
6.3. Payments may be processed by third-party payment providers.
6.4. The User authorizes the applicable payment provider to process the payment for the selected product.
6.5. Taleino does not store complete payment card details unless explicitly stated in the Privacy Policy and permitted by applicable law.
6.6. An Order is considered submitted after the payment process has been successfully completed or otherwise confirmed by the payment provider.
6.7. If a payment fails, is reversed, or is not successfully completed, Taleino may decline to process or deliver the Order until payment has been successfully confirmed.
7. Order Processing and Delivery
7.1. Personalized Stories are delivered digitally.
7.2. Depending on the purchased product, delivery may take place through:
- the User's Taleino Account;
- a download link;
- email;
- another digital delivery method specified during checkout.
7.3. The estimated delivery time, where applicable, will be communicated during the ordering process.
7.4. Automated generation may take some time depending on system availability, Order complexity, and technical conditions.
7.5. The User is responsible for providing a valid email address and maintaining access to the email account used for the Order.
7.6. If delivery fails because the User provided an incorrect email address or otherwise prevented delivery, Taleino may require the User to provide corrected information before attempting delivery again.
8. Digital Content and Consumer Rights
8.1. Taleino products may constitute digital content supplied without a tangible medium.
8.2. Where applicable law provides consumers with a statutory right of withdrawal, Taleino will respect that right subject to applicable statutory exceptions.
8.3. For digital content, applicable law may permit the right of withdrawal to cease once:
- the User has expressly consented to the beginning of performance before the expiry of the withdrawal period; and
- the User has acknowledged that the right of withdrawal is lost as a result of giving such consent.
EU consumer rules expressly provide for this exception for digital content not supplied on a tangible medium.
8.4. Where required by applicable law, Taleino will obtain the relevant express consent and acknowledgement during checkout before beginning the applicable digital-content service.
8.5. Nothing in these Terms removes or restricts mandatory consumer rights relating to defective, non-conforming, or undelivered digital content.
8.6. EU rules on digital content provide consumers with remedies where digital content does not conform, including, depending on the circumstances, bringing the content into conformity, a price reduction, or termination of the contract.
9. Refunds
9.1. Refunds are governed by the Taleino Refund Policy:

9.2. The Refund Policy forms an integral part of these Terms.
9.3. Where the User is legally entitled to a refund, Taleino will process the refund in accordance with applicable law and the Refund Policy.
9.4. Where a Personalized Story has already been generated and delivered, a refund may be unavailable where the applicable statutory right of withdrawal has validly ceased or where no other legal basis for a refund exists.
9.5. This does not affect mandatory legal remedies available to consumers where the Digital Content is defective or does not conform to the applicable contract.
10. User Content and Personal Information
10.1. The User may submit information for the purpose of creating a Personalized Story.
10.2. The User confirms that they have the right to provide the submitted information to Taleino for processing.
10.3. The User must not submit information that they are prohibited from sharing or processing under applicable law.
10.4. The User should not submit unnecessary sensitive personal information when creating a story.
10.5. Personal data is processed in accordance with the Taleino Privacy Policy:

10.6. Taleino may use third-party service providers necessary to operate the Service, including hosting, payment processing, email delivery, analytics, content generation, storage, and other infrastructure providers.
10.7. Information about relevant processors and service providers is provided in the Privacy Policy where required.
11. Intellectual Property
11.1. The Taleino website, software, user interface, branding, trademarks, design, underlying technology, templates, systems, and other materials provided by Taleino are owned by or licensed to the Provider unless otherwise stated.
11.2. These Terms do not transfer ownership of Taleino's underlying software, systems, templates, technology, or trademarks to the User.
11.3. Subject to payment and compliance with these Terms, Taleino grants the User a non-exclusive right to access and use the delivered Personalized Story for personal, non-commercial purposes, unless the applicable product expressly provides otherwise.
11.4. The User may download, save, view, and share their purchased Personalized Story for ordinary personal and family use, subject to any restrictions stated for the particular product.
11.5. The User may not:
- resell a Taleino Personalized Story as their own product;
- commercially redistribute Taleino-generated content unless expressly permitted;
- remove copyright or ownership notices where applicable;
- use Taleino materials to create a competing service;
- reproduce or exploit Taleino's underlying software, templates, systems, or technology.
11.6. Unless otherwise expressly stated, purchasing a Personalized Story does not transfer ownership of Taleino's underlying technology or intellectual property.
12. AI-Generated Content
12.1. Taleino may use artificial intelligence and automated content-generation systems.
12.2. AI-generated content may contain unexpected wording, creative interpretations, factual inaccuracies, omissions, or other imperfections.
12.3. Taleino aims to provide age-appropriate and suitable children's content, but automated generation cannot guarantee that every generated element will be perfect in every circumstance.
12.4. Users should review Personalized Stories before giving them to a child, particularly where the User has requested unusual names, themes, characters, or other customized content.
12.5. Taleino may implement technical and moderation measures intended to prevent prohibited or inappropriate content from being generated.
12.6. If the User identifies inappropriate, unsafe, or materially defective content, they should contact [email protected].
13. Prohibited Use
The User must not use Taleino:
- for unlawful purposes;
- to generate content intended to facilitate criminal activity;
- to generate content that infringes third-party intellectual property rights;
- to impersonate another person for fraudulent purposes;
- to attempt unauthorized access to Taleino systems;
- to interfere with the operation or security of the Service;
- to use bots, scraping, or automated systems to abuse or overload the Service;
- to reverse engineer or attempt to extract the underlying models, prompts, systems, or source code except where such restriction is prohibited by applicable law;
- to circumvent technical restrictions or pricing limitations;
- to resell access to the Service without authorization.
14. Service Availability
14.1. Taleino will make reasonable efforts to maintain the availability of the Service.
14.2. However, Taleino does not guarantee uninterrupted or error-free operation.
14.3. Temporary unavailability may occur because of:
- maintenance;
- updates;
- infrastructure failures;
- third-party service interruptions;
- internet or telecommunications failures;
- security incidents;
- events beyond Taleino's reasonable control.
14.4. Taleino may modify, suspend, or discontinue features of the Service where reasonably necessary.
14.5. Where a change materially affects a paid product or the User's contractual rights, Taleino will provide notice where required by applicable law.
15. Disclaimer
15.1. Taleino is a digital content service and is not a financial, medical, legal, educational, or psychological advisory service.
15.2. The stories created through Taleino are intended for entertainment and personal use.
15.3. Taleino does not guarantee that a story is suitable for every child, family, cultural context, educational purpose, or individual circumstance.
15.4. Parents and legal guardians are responsible for determining whether a particular story is appropriate for their child.
15.5. Nothing in the Service should be interpreted as professional advice.
16. Limitation of Liability
16.1. To the maximum extent permitted by applicable law, Taleino will not be responsible for losses resulting from:
- incorrect information supplied by the User;
- the User's failure to review submitted personalization information;
- unauthorized access resulting from the User's failure to protect Account credentials;
- interruptions caused by third-party services;
- events outside Taleino's reasonable control.
16.2. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
16.3. In particular, mandatory consumer rights and statutory remedies remain unaffected by these Terms.
16.4. Where permitted by applicable law, Taleino's aggregate contractual liability for a specific paid Order will not exceed the amount actually paid by the User for that Order.
17. Suspension and Termination
17.1. The User may stop using Taleino at any time.
17.2. The User may request deletion of their Account in accordance with the Privacy Policy.
17.3. Taleino may suspend or terminate an Account where reasonably necessary because of:
- material violation of these Terms;
- fraudulent activity;
- unauthorized access attempts;
- abuse of the Service;
- unlawful use;
- security risks;
- payment fraud or unauthorized payment activity.
17.4. Where appropriate and legally permissible, Taleino will notify the User before terminating access.
17.5. Suspension or termination does not affect rights and obligations that by their nature should survive termination.
18. Force Majeure
18.1. Taleino will not be responsible for failure or delay caused by circumstances beyond its reasonable control.
18.2. Such circumstances may include:
- natural disasters;
- major internet or telecommunications failures;
- cyberattacks;
- infrastructure failures;
- third-party provider outages;
- governmental actions;
- armed conflicts;
- epidemics or other major emergencies.
18.3. Taleino will make reasonable efforts to restore affected services when circumstances permit.
19. Privacy and Cookies
19.1. Personal data is processed in accordance with the Taleino Privacy Policy:

19.2. Cookies and similar technologies are governed by the Taleino Cookie Policy:

19.3. The User should review these documents before using the Service.
20. Changes to These Terms
20.1. Taleino may update these Terms from time to time.
20.2. Changes may be made because of:
- changes in applicable law;
- changes to the Service;
- introduction or removal of features;
- changes to payment or delivery processes;
- security or operational requirements.
20.3. The updated version will be published on the Taleino website.
20.4. For material changes affecting existing users or paid services, Taleino will provide notice where required by applicable law.
20.5. The version of the Terms applicable to an Order will generally be the version in force when the Order was placed, unless a different rule is required by applicable law.
21. Governing Law and Dispute Resolution
21.1. These Terms are governed by the laws applicable to the Provider, subject to mandatory consumer protection laws applicable to the User.
21.2. The parties should first attempt to resolve any dispute by contacting:
21.3. Taleino will make reasonable efforts to review and respond to complaints within a reasonable period.
21.4. If a dispute cannot be resolved directly, the User may have access to mandatory consumer dispute-resolution mechanisms available under the laws of their country of residence.
21.5. Nothing in these Terms prevents a consumer from exercising mandatory rights to bring proceedings before a competent court or other authority available under applicable law.
21.6. The former European Union Online Dispute Resolution (ODR) Platform is not referenced in these Terms because it was discontinued effective July 20, 2025.

23. Electronic Acceptance
23.1. Before creating an Account or placing an Order, the User may be required to confirm acceptance of these Terms and the applicable legal documents.
23.2. The acceptance mechanism may include a checkbox or other affirmative action such as:
"I agree to the Taleino Terms of Service and Privacy Policy."
23.3. Where required for digital content, the checkout process may additionally include a separate confirmation that:
- the User requests Taleino to begin providing the digital content before the end of the applicable withdrawal period; and
- the User acknowledges that, where permitted by applicable law, the right of withdrawal is lost once the relevant digital content provision begins.
23.4. Taleino may record the following information as evidence of electronic acceptance:
- date and time;
- version of the Terms;
- relevant Order information;
- account identifier or email address;
- technical information reasonably necessary to establish the acceptance event.
23.5. The User may request information about their contractual records by contacting [email protected].
23.6. Acceptance of these Terms does not replace any separate consent that may be legally required for processing personal data, marketing communications, or other purposes.
